Apple to settle iCloud trademark lawsuit

You may be aware of the iCloud Communications suing Apple for the iCloud trademark. It’s more than a week now that Apple got sued. iCloud Communications claimed a part of their business on cloud computing and Apple’s new iCloud is too similar, leading to confusion.

But USPTO’s database says iCloud Communications has not registered for an iCloud trademark. Moreover, iCloud Communications used geticloud.com as their domain and not something like iCloud.com. If you aren’t aware, Apple purchased all the rights and trademarks from Xcerion for iCloud.com recently.

Now, reports say that Apple may be settling a trademark lawsuit with iCloud Communications. This was revealed by lawyer Brad Salai of Harter Secrest and Emery law firm. He also says that Apple won’t mind taking its chances in the court if the iCloud Communications wants to do so. Here’s what The Loop reports:

“Although a trademark registration does give you additional rights, there are also what are called ‘common law rights,'” said Brad Salai, a partner with Harter Secrest & Emery who practices patent and trademark law.
